As I wrote here yesterday, I believe the feeding frenzy currently taking place at the Copenhagen trough will result in the ultimate global governance of every man woman and child on the planet. A climate treaty may not actually be signed and agreed upon by the 192 countries whose representatives are currently living LARGE on caviar and limousines at the conference, but the rules such a treaty might impose will still take effect.

The main reason to believe this will happen is that President Barack Obama has pulled an end run around the American people and the legislators they have elected by having the Environmental Protection Agency (EPA) declare carbon a toxic pollutant, despite the fact that all life on the planet is basically carbon-based. But fascists can never be swayed by facts and Obama has shown that when it comes to imposing his draconian agenda he isn’t particularly squeamish about violating the principles of the Constitution or the rights of the people.

The EPA ruling gives that agency the power to impose limits on the amount of carbon and other so-called “greenhouse gases” that can be released into the atmosphere. Traditionally the EPA has enforced its policies through the levying of fines. Strictly speaking if this ruling is to go unchallenged, the EPA could theoretically regulate every single aspect of every American’s life, including the number of children one could legally have. It’s not out of the realm of possibility that the EPA could actually impose fines on individuals for breathing.

Among the hallmarks of progressivism, which has traditionally spawned fascism, is the belief that “experts” always know what’s better for society than individuals and that there be a constant crisis which must be dealt with. Of course, the definition of crisis is left to the discretion of the experts under whose governance the people find themselves.

The EPA ruling essentially makes Congress irrelevant, unless the ruling is challenged in federal court and soundly defeated, as it eventually will be. Trouble is that all this takes time, effort and oodles of cash, of which the US government has all three. But one group has already vowed to challenge the ruling in court. The Competitive Enterprise Institute, which has successfully challenged climate legislation in the past, has vowed to take the EPA to court because the EPA’s decision was based on research that is now at the centre of the “climategate” scandal.

I submit that this is the wrong reason to challenge the ruling. The making of laws and the regulation of commerce are constitutionally delegated to the Congress and the states. As such, imposing rulings on America such as the EPA’s is unconstitutional because the EPA does not have the authority to pass laws, just as the courts do not have that authority.

The reason the EPA declared “greenhouse gases” to be toxic is as plain as the nostrils on Henry Waxman’s face. Congress realizes that passing the Waxman-Markey cap and trade bill would impoverish Americans to a degree previously only seen during the Great Depression and its passage would spell political suicide for all those who supported it. So it’s clear that in order to get what he wants, Barack Obama has basically co-opted the Congress and is imposing his agenda through the regulatory back door.

There’s little doubt that the Obama administration does not represent the American people’s best interests. Given its obvious belief that multilateral global governance is preferable to representing America, the Obama Administration has become the world’s representative to America. This is one of the main reasons that there will be no second term for Barack Obama, whose presidency is making the Carter presidency look stellar.

What’s important now is for Americans to resist, legally or otherwise. the regulations the administration is attempting to impose. Not doing so is an option that will have catastrophic consequences.
